Sonora, CA — It´s official; Judge James A. Boscoe has found in favor of the City of Sonora and the developer of the Lowe´s Home Improvement project, California Gold.
Suit was brought against these parties by the Citizens For Responsible Growth. In Judge Boscoe´s decision, handed down moments ago, he states; “Based on such evidentiary record, and the applicable law, both of which are set forth in greater detail below, the Court concludes that the Petitioner (the Citizens For Responsible Growth) has failed to meet its burden to show that in approving the Lowe´s project, the City violated the California Environmental Quality Act (C.E.Q.A.). The burden is on the Petitioner to show, for each alleged violation of C.E.Q.A., that the City committed a prejudicial abuse of discretion. This requires showing that the City has not proceeded in a manner required by law or that the determination or decision is not supported by substantial evidence. This the Petitioner has failed to do.”
The Lowe´s project has already been unanimously approved by the City of Sonora Planning Commission.
