The U.S. Supreme Court refused without comment today to consider a challenge by Roseville and Rocklin to the Thunder Valley Casino near Interstate 80.
That´s the main route between Northern California and the gambling cities of Reno and Sparks, Nevada.
The decision lets stand earlier decisions by a federal appeals court and a district judge dismissing the suit. The United Auburn Indian Community opened the casino last year.
The federal judge has threatened to require the cities to pay the tribe´s legal fees for what he described as a “frivolous” lawsuit. That decision has been on hold pending the appeal. The cities argued the federal government failed to properly consider the casino´s affect on the surrounding community.
