Scott Peterson´s lawyer is asking the California Supreme Court for a new jury and a change of venue for the penalty phase of his client´s double-murder trial.
Attorney Mark Geragos filed the motion Wednesday.
A state appeals court ruled Tuesday that the same jury that convicted Peterson of murder would decide whether he should be sentenced to death or life in prison without parole.
Judge Alfred A. Delucchi denied Geragos´ motion for a new jury in San Mateo County or elsewhere on Monday.
The attorney claims that the jury is now tainted by public opinion.
Peterson was convicted on November 12th of first-degree murder in the death of his eight-months pregnant wife, Laci.
He was also convicted of second-degree murder for the death of her fetus.
