A former student at Summerville High School is suing four Tuolumne County Sheriff´s investigators for false
arrest. Nineteen year old David DeCoster filed the suit in US District Court in Fresno yesterday, claiming he was arrested despite evidence that he was innocent
of an alleged conspiracy to helping plot a sword and knife attack at the school last year. The suit also claims that because of a physical disability, he was
incapable of assaulting anyone.
DeCoster was expelled from school, locked up in county jail for two months then released the day his murder
conspiracy trial was set to begin. DeCoster´s attorney claims investigators twisted his answers in interviews, and cajoled him into speculation as to what his role
in the alleged attack might be and latched onto that speculation as evidence.
DeCoster and another 17 year old boy were arrested in April of last year
for the conspiracy which investigators say had been in the works for well over a year. The other boy pleaded guilty to a minor charge and sentenced to time
already served.
The suit doesn´t specify the amount of damages being sought. No word on when the suit will be heard in a courtroom.
