Sacramento, CA — California’s new law requiring school children to be vaccinated is facing a legal challenge.
A lawsuit has been filed in federal court by a group of parents, along with the non-profit group Education 4 All. It argues that SB 277 violates California’s Constitutional guarantee that a child has a right to an education. The group also requests that the judge suspend the new law until the legal matter is settled.
SB 277 eliminated the personal belief exemption for immunizations. In addition to public schools, the law also applies to private schools and daycare facilities.
The bill was introduced following a measles outbreak in Disneyland during December of 2014. The new legislation was approved following contentious debates at the state capitol in Sacramento and was signed last year by Governor Jerry Brown.
