Copper Couple Reclaim Home Following Eviction
A Copperopolis couple in danger of losing their home to foreclosure for failing to pay $120 in homeowner´s dues soon will reclaim their home´s deed as part of a lawsuit settlement reached Friday, according to the Stockton Record.
Thomas and Anita Radcliff had sued the Association, the association´s collection agent and the person who bought their home after it was auctioned for their failure to pay homeowner´s dues.
The Radcliffs cited unfair debt-collection practices and breach of contract, contending they were not given proper notice about their unpaid association debt before they were evicted and their home was auctioned off.
The Radcliffs´ case prompted proposed state legislation addressing homeowners association foreclosure issues.
