In regards to the prosecution of the least egregious act of former President Trump, we refer to a speech made in 1940 by then U.S. Attorney General Robert H. Jackson who said, in part that: “The most dangerous power of the prosecutor: that he will pick people that he thinks he should get, rather than pick cases that need to be prosecuted… picks some person whom he dislikes or desires to embarrass, or selects some group of unpopular persons and then looks for an offense… (there is where) the greatest danger of abuse of prosecution power lies.”
