Judge Refuses Separate Trials In Fatal Dog Attack Case

The San Francisco couple charged in last year´s fatal dog attack on Diane Whipple will be tried together. A judge refused to order two separate trials for Marjorie Knoller and Robert Noel. Judge James Warren says it´s a classic case for a joint trial.

The couple face charges of involuntary manslaughter and keeping a vicious dog. Knoller also is charged with second-degree murder. Warren also decided that sex related testimony would only be relevant if the prosecution could prove it was connected to the dog´s behavior. Warren says hearings in his chambers would take place as evidence arose.
