A Copper Cove couple will remain in their home for now, according to a judge´s ruling Wednesday.
Last year, Thomas and Anita Radcliffe failed to make a 120-dollar homeowner´s association payment on their 289-thousand dollar home. The association finally sold the house at a foreclosure auction for 70-thousand dollars.
Now, the buyer wants the Radcliffes kicked out of the house, but a judge sided with the couple´s attorney, who says the lawsuit summons was improperly served.
Calaveras County Superior Court judge Douglas Mewhinney said Wednesday the couple can stay… for now… because paperwork documenting the attempts to serve the couple were inconsistent.
Attorneys for the buyer of the house argue sufficient attempts were made to serve the papers. The case continues in Calaveras County Superior Court.
