Calaveras Killer Will Undergo Testing

San Andreas, CA — A Calaveras man on death row will reportedly undergo tests this summer to assess whether he suffers from mental retardation.
George Smithey was convicted in 1989 of killing 25 year old Cheryl Nesler in Glencoe.
The Stockton Record newspaper reports that Judge Thomas A. Smith signed an order for the tests after the Calaveras County Deputy District Attorney and State Public Defender both came to an agreement.
If tests show that Smithey suffers from mental retardation he would be taken off death row.
